• 1 Applicability to Business Customers and Definitions

(1) The following General Terms and Conditions apply to all deliveries between Cyto Labor-und Vertriebs GmbH and a consumer.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity (Section 13 of the German Civil Code (BGB)).

• 2 Formation of a Contract, Storage of the Contract Text

(1) The following provisions regarding the conclusion of a contract apply to orders placed through our online store http://www.cytolabor.de

(3) The presentation of goods in our online store does not constitute a legally binding offer to enter into a contract on our part, but is merely a non-binding invitation to the consumer to order goods. (4) Upon receipt of an order in our online store, the following provisions apply: The consumer submits a binding offer to enter into a contract by successfully completing the ordering process provided in our online store.

The ordering process consists of the following steps:

We will confirm receipt of your order on the following business day via email (order confirmation), specifying the shipping date for the ordered items. With this confirmation, we accept your offer.

(5) Storage of the contract text for orders placed through our online store: Upon confirmation of your order, we will send you the order details and our Terms and Conditions via email. You can also view the Terms and Conditions at any time at https://www.cytolabor.de. For security reasons, your order details are no longer accessible via the Internet.

• 3 Prices, Shipping Costs, Payment, Due Date

(1) The prices listed include the statutory value-added tax and other price components. Shipping costs are added separately.

(2) The consumer has the option to pay by invoice.

(3) The consumer is obligated to pay the invoice within 7 days of receipt.

• 4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for immediate shipment. Delivery will take place within 15 business days at the latest. The delivery period begins upon order confirmation.

(2) Even in the case of a sale by mail order, the risk of accidental loss or accidental deterioration of the sold item does not pass to the buyer until the item is delivered to the buyer.

• 5 Retention of Title

We reserve title to the goods until the purchase price has been paid in full.

Right of Cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days, starting from the day on which you or a third party designated by you—other than the carrier—took possession of the goods.

For hygiene reasons, returning products that have already been opened is prohibited; these products cannot be accepted for return. If you wish to return the “Mikroflor” product, it must not have been opened.

by providing a clear statement (e.g., a letter sent by mail, fax, or email) regarding your decision to cancel this contract. You may use the attached sample cancellation form for this purpose, although its use is not required.

Consequences of Cancellation

If you cancel this contract, we must refund to you all payments we have received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.

You must return or hand over the goods to us immediately, and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you ship the goods before the fourteen-day period expires.

You are responsible for the direct costs of returning the goods.

• 8 Warranty

The statutory warranty provisions apply.

• 9 Liability for Defects

If the purchased item is defective, the provisions of statutory liability for defects apply.

The customer is asked to file a claim with the delivery company regarding any goods delivered with obvious damage caused during shipping and to notify the seller of this. If the customer fails to do so, this will have no effect on their statutory or contractual claims for defects.

• 10 Language of the Contract

German is the sole language available for this contract.
